Welcome to Mile High Hikes! These Terms of Service ("Terms") govern your use of the Mile High Hikes website, booking system (FareHarbor), and guided hiking services (collectively, the "Service"). By using our website or booking a hike with us, you agree to these Terms. If you don’t agree, that’s okay — but you probably shouldn’t use the Service.
1. Definitions
User means anyone visiting our website or booking a hike through Mile High Hikes.
Service refers to the guided hikes, nature walks, and outdoor experiences provided by Mile High Hikes.
2. Acceptance of These Terms
By using our website or booking a hike, you confirm that you’ve read, understood, and agreed to these Terms.
If you're booking for a group, you're responsible for making sure everyone in your group understands and agrees to these terms as well.
3. Use of the Service
Our Service is intended for booking and participating in guided hikes and outdoor experiences.
When using the Service, you agree to:
Provide accurate information when booking
Follow instructions from your guide at all times
Respect the natural environment and other hikers
Follow all applicable park rules and local laws
We reserve the right to remove anyone from a hike if their behavior creates safety risks for themselves, the group, the guide, or the environment.
4. Assumption of Risk
Hiking and outdoor recreation come with inherent risks. These risks include, but are not limited to:
Uneven terrain
Slippery rocks or mud
Sudden weather changes
Wildlife encounters
Altitude-related effects
Trips, falls, or other injuries
By booking or participating in a Mile High Hikes experience, you acknowledge and accept these risks and voluntarily choose to participate.
You agree that participation is at your own risk.
5. Waiver of Liability
By booking or participating in a hike, you agree to waive, release, and hold harmless Mile High Hikes, its guides, owners, contractors, and affiliates from any and all claims, liabilities, damages, injuries, or losses arising from participation in our hikes or use of our services.
This includes claims related to:
Personal injury
Property damage
Accidents on trails or outdoor locations
Weather conditions
Wildlife encounters
Any other inherent risks of outdoor recreation
By agreeing to these Terms, you also agree not to bring legal action or lawsuits against Mile High Hikes related to participation in our services, to the fullest extent permitted by law.
6. Weather, Safety & Guide Discretion
Colorado weather can change quickly, and trail conditions can vary.
All hikes operate at the discretion of the guide for the day, who may modify routes, timing, or the hike itself for safety reasons.
Guides may cancel, delay, shorten, or adjust hikes due to:
Weather conditions
Trail closures
Safety concerns
Environmental hazards
Group readiness or safety
Guide decisions are final and made with safety as the top priority.
7. Booking & Refund Policy
All bookings are non-refundable.
Because hikes require scheduling, guide availability, and trail logistics, we do not offer refunds once a booking is made.
In rare cases where a hike cannot proceed due to severe weather or safety concerns, Mile High Hikes may — at our sole discretion — offer:
A rescheduled hike
A credit for a future hike
Refunds are not guaranteed and are not automatically issued.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
By using our website or booking a hike, you agree to the practices outlined in that policy.
9. Changes to These Terms
We may update these Terms occasionally to keep things current and legally sound.
If we make major changes, we’ll update the date at the top of this page.
Your continued use of the Service means you accept the updated Terms.
10. Governing Law
These Terms are governed by the laws of the United States and the state in which Mile High Hikes operates.
Any disputes that cannot be resolved informally will be handled in the appropriate courts within that jurisdiction.
